20 US States File Lawsuit Against Trump Over $100,000 H-1B Visa Fee

Twenty U.S. states have filed a federal lawsuit challenging former President Donald Trump’s decision to impose a $100,000 fee on H-1B work visas for skilled foreign workers. The states allege the policy, introduced by the Department of Homeland Security, is unlawful and exceeds the government’s administrative authority.

According to the lawsuit, the fee hike could severely impact key sectors such as education, healthcare, and public services by discouraging international teachers, doctors, and other professionals from working in the U.S.

Traditionally, H-1B visa fees covered only administrative costs, but the new policy drastically increased the amount for visa applications filed after September 21, 2025. States say this change undermines industries already facing worker shortages.

The case—led by California and Massachusetts — reflects growing opposition to Trump’s immigration and employment policies, arguing they could harm U.S. competitiveness and essential services.
